This contest is sponsored by Transat Holidays, (the “Contest Sponsor”). Contest starts at or about 12:00:01 a.m. ET August 1, 2007 and ends at 11:59:59 p.m. ET on March 30, 2008 (“the Contest Closing Date”).
ELIGIBILITY:
This contest is open to all legal residents of Canada who have reached the age of majority in the province or territory in which they reside, except employees (and persons with whom they are domiciled) of the Contest Sponsor, their advertising and promotional agencies and the independent contest judging organization.
TO ENTER: there are two (2) ways to enter:
Online Entry: visit www.marlintravel.ca to complete the official contest entry form by entering your name, address and daytime telephone number where you may be reached, in order to receive one (1) entry into the contest.
Ballot Entry: complete and submit the official contest ballot by entering your name, address and daytime telephone number where you may be reached, in order to receive one (1) entry into the contest. Ballots and ballot boxes can be found at participating Marlin Travel Bridal Tradeshows.
Odds of winning will depend upon the number of eligible entries received by the Contest Closing Date. All entries must be received by the Contest Closing Date in order to qualify. Limit of one entry per person/household/email by any method address allowed. In the event it is discovered that you attempted to enter more than once all of your entries will be void.
The Contest Sponsor will not be responsible for late, delayed, misdirected, lost, or incomplete entries. By entering the Contest, entrants accept and agree to be bound by the official contest rules and regulations as set out herein, and accept the decisions of the independent contest judging organization and the Contest Sponsor as final and binding in all respects. All information obtained for this contest will only be used for the purpose of conducting the contest.
PRIZES:
There will be one (1) Grand Prize awarded, consisting of an all-inclusive trip for two (2) adults to the Le Regency Club at Riviera Princess in the Mayan Riviera, Mexico. The Grand Prize includes return economy airfare from the international airport nearest to the winner’s place of residence, transfer to and from airport and resort, hotel accommodations (based on double occupancy in a deluxe junior suite) for seven (7) nights. All-inclusive items include buffet breakfast, lunch and dinner, a la carte dining, 24 hour room service, 24 hour snacks & beverages, unlimited local and selected international drinks, mini-bar (water, soft drinks, beer), Regency Club concierge service, turn-down service, fruit basket, distinct id bracelet, 15% discount spa, one (1) bottle of tequila, one (1) beach party, free internet access in Club House, daily activities program , nightly entertainment and selected non-motorized water sports. The approximate retail value of the trip is $4000(CAN) based on rates available at start of contest. Actual retail value of the Grand Prize package may vary depending on departure airport.
Trip must be taken before October 31, 2008 (excluding major holidays) and is subject to availability of both Transat Holidays and the hotel at time of reservation. Winner has to respect the validity dates of the promotion and will have to accept any alternatives proposed by Transat Holidays, at their sole discretion. No Extensions permitted. Reservations must be confirmed forty-five (45) days prior to travel dates. Once reservations have been confirmed, no changes will be permitted. All bookings are subject to 100% cancellation penalties. Terms and conditions of Transat Holidays Winter Sun 2007-2008 brochure apply. Services required for passengers with special needs are not included in the package and may not be available.
The Grand Prize winner and his/her travel companion (who must have reached the age of majority in the province or territory of residence) will be responsible for obtaining any required travel, health and insurance (recommended) documents. Gratuities, applicable taxes, incidentals and all other expenses not specifically mentioned above are the sole responsibility of the winner and their travel companion. The winner and their travel companion must travel from the same departure airport and on the same itinerary. Air travel to the hotel destination will be exclusively on flights sold by Transat Holidays. The Grand Prize may not be exchanged in whole or in part for cash or other substitutes, is non-transferable, non-refundable, non-saleable and must be accepted as awarded, except that the Contest Sponsor reserves the right at their sole discretion to substitute the prize for a prize of equal or greater value. Any unused portion of the Grand Prize value is forfeited.
Draw
A Random Draw will be conducted at or about 2:00 pm on April 15, 2008 in Brantford, ON, by an independent contest judging organization, from all eligible entries received. Odds of being selected depend upon the total number of eligible entries received by the Contest Closing Date.
The selected entrant will be contacted by mail, courier or telephone within five (5) business days of the draw date. If the selected entrant cannot be contacted within five (5) business days, he/she will be disqualified and a new random draw from the remaining eligible entries will be conducted to select another entry and the process noted above will be repeated until a selected entrant is contacted or there are no more eligible entries, whichever comes first.
Before being declared a winner, each selected entrant, must first correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question within ten (10) business days of prize notification. . The selected entrant and their travel companion (who must be the age of majority) will also be required to sign a Declaration and Release Form (the “Release Form”) confirming compliance with these Official Contest Rules & Regulations, acceptance of the Grand Prize as awarded without substitution, and releasing the Contest Sponsor, its affiliated and related companies, advertising and promotional agencies, the independent contest judging organization and their respective shareholders, directors, officers, employees, agents, dealers, representatives, successors and assigns from any liability in connection with the Grand Prize or this Contest.
Failure to answer the mathematical skill-testing question correctly or failure to return the Release Form within the time period indicated on the Release Form will cause the Grand Prize to be forfeited and a new random draw from the remaining eligible entries will be conducted to select another entry and the process noted above will be repeated until a winner is declared or there are no more eligible entries, whichever comes first.
General
This Contest is subject to all applicable Federal, Provincial, and Municipal laws and regulations. All decisions of the Independent Contest Judging Organization are final and the Contest Sponsor and Independent Contest Judging Organization shall not be held responsible for any accident, negligence, printing, administrative or other errors that may arise or occur in connection with the Contest with no obligation or liability, subject to applicable law. Unless otherwise provided for in these Official Contest Rules, all personal information gathered will be used only for the purpose of conducting this Contest in accordance with the Contest Sponsors privacy policy at www.marlintravel.ca.
No correspondence will be entered into except with the selected entrant. By entering this Contest and accepting the prize, the winner consents to the use of his/her name, city of residence, video image, voice, and/or photograph in any related publicity or Internet posting without further notification or compensation.
By accepting the prize, the winner and their travel companion releases and agrees to hold the Contest Sponsor, its directors, employees, officers and agents, including without limitation, its advertising and promotion agencies and the sweepstakes judging organization, harmless from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of this prize.
All entries become the property of the Contest Sponsor upon receipt and will not be returned. No responsibility will be taken for any failure of the web site during the promotion or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line, or Internet entry to be received by the Contest Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion.
The Contest Sponsor reserves the right, in its sole discretion and subject to the consent of the Regie des alcools, des courses et des jeux with respect to the province of Quebec, to cancel or suspend this Contest should a virus, bug or any other cause beyond the reasonable control of the Contest Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are forged, falsified, altered or tampered with in any way.
In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed submitted by the “authorized account holder”. “Authorized Holder” shall mean the natural person assigned to the email or text messaging address by an Internet service provider, on-line service provider, phone company, mobile phone service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email/text messaging addresses for the domain associated with the submitted email/text message address. Contest Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her entries) who tampers with the entry process.
For Quebec residents, any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Regie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.
